Partner Visas
Partner visas allow spouses or de facto partners of Australian citizens, permanent residents, or eligible New Zealand citizens to live in Australia.
- Types of Partner Visas:
- Onshore Partner Visa (Subclass 820/801): For partners already in Australia. Grants temporary residency while the permanent visa is processed.
- Offshore Partner Visa (Subclass 309/100): For partners applying from outside Australia.
- Two-Stage Process:
- Temporary Partner Visa: Granted after proving relationship criteria.
- Permanent Visa Stage: Typically two years later, applicants may become eligible for a permanent visa (Subclass 801 or 100). In some cases, permanent residency may be granted at the same time as the temporary visa if the evidence of a genuine relationship is strong.
- Partner of a New Zealand Citizen:
- Subclass 461: For partners of New Zealand citizens who cannot qualify as eligible New Zealand citizens but hold or can obtain a Special Category Visa (Subclass 444). Allows a stay of up to five years.
- Key Requirements for Partner Visas:
- Marital Status: Legally married or in a de facto relationship.
